Risk Exposure

Why Immigration Advisers Need Professional Indemnity Insurance

The Immigration Advice Authority (IAA), formerly the Office of the Immigration Services Commissioner (OISC), regulates immigration-advice organisations and advisers in the UK.

All IAA-regulated organisations must maintain current and adequate Professional Indemnity Insurance. An organisation cannot enter or remain within the IAA regulatory scheme without this cover.

Immigration advice can have significant consequences for clients. Errors involving applications, deadlines, supporting evidence or advice may lead to additional legal costs, delay and allegations of financial or other loss. The insurance arranged should reflect the organisation's authorised level, activities and potential exposures.

Scope of Cover

Typical Legal Services

IAA-regulated organisations provide a range of immigration advice and services, subject to their approved levels and categories. Insurance cover also remains subject to full disclosure, insurer acceptance and the terms, conditions and exclusions of the policy.

Visa, entry-clearance, leave-to-remain and citizenship applications
Family and dependant applications
Employer sponsor-licence and compliance advice
Asylum, human-rights and complex casework, where appropriately authorised
Appeals and immigration tribunal representation, where undertaken by an appropriately authorised Level 3 adviser

Illustrative Claims Scenarios

Typical Claims Scenarios

These scenarios are illustrative examples only. Any policy response would depend upon the circumstances of the claim and the terms, conditions, exclusions and limits of the insurance.

1

Missed Application Deadline

An immigration adviser fails to submit an application before the client's existing leave expires. The client alleges that the error jeopardised their immigration status and resulted in additional application costs, legal expenses and financial loss.

2

Inadequately Prepared Asylum Application

An adviser provides incorrect advice or inadequately prepares an asylum application, which is subsequently refused. The client alleges that the adviser's negligence caused additional legal costs, delay and the loss of an opportunity to present the case properly.

3

Sponsor Licence Compliance Failure

Incorrect advice concerning sponsor-licence duties contributes to enforcement action or revocation by the Home Office. The employer alleges business interruption and financial loss and pursues a claim against the adviser.
